MEMENTO MORI has created this website to provide information about the brand and its products for personal use. Although significant effort has been made to ensure that the visual representation of MEMENTO MORI jewelry displayed on the website is faithful to the color, design, style, and  other aspects of the original products, there may be slight variations, distortions, or differences when compared to the original products. These differences may be due to technical factors such  as your browser or device settings. Consequently, MEMENTO MORI and its suppliers will not be  responsible for any apparent differences between the images of the products displayed on the  website and the original products.

The material from MEMENTO MORI is protected by the Spanish Intellectual Property Law (Royal Legislative Decree 1/1996, of April 12) and the European directives on copyright. No part of the  material from MEMENTO MORI may be reproduced, distributed, publicly communicated,  transformed, or used in any other way, in whole or in part, without prior written consent from MEMENTO MORI. 

Trademarks 

The trademarks, logos, trade names, and other distinctive signs that appear on the MEMENTO  MORI website are registered and are the exclusive property of MEMENTO MORI or its licensors. The use of these trademarks without the express authorization of MEMENTO MORI is prohibited and constitutes a violation of the applicable trademark laws (Law 17/2001, of December 7, on Trademarks). 

Download and Use of Material 

You are allowed to download an electronic copy or print a copy of the material offered through the website for your personal use for non-commercial, educational, private, or domestic purposes only, provided that the intellectual property notices (©) and trademarks (™) remain intact and without modifications, deletions, or changes. Governing Law and Jurisdiction 

These Terms of Use will be governed by and interpreted in accordance with Spanish law. For the resolution of any disputes that may arise from access or use of the website, the user expressly submits to the courts and tribunals of the city of Seville, Spain, waiving any other jurisdiction that may correspond. 

Limitation of liability

MEMENTO MORI strives to ensure that the information displayed is accurate and complete. However, MEMENTO MORI does not declare or guarantee that the MEMENTO MORI Material is accurate, error-free, or reliable, nor that the use of the MEMENTO MORI Material will not infringe the rights of third parties. 

MEMENTO MORI and its suppliers do not guarantee that the functional and/or technical aspects of the website or the MEMENTO MORI Material are error-free, nor that the website, MEMENTO MORI Material, or the servers that make them available are free of viruses or other harmful  elements. Should the use of the website or the MEMENTO MORI Material result in the need to repair or replace goods, materials, equipment, data, or other items, MEMENTO MORI and its suppliers will not be responsible for such costs. 

Without limiting the generality of the foregoing, everything offered on the website is provided “AS  IS” AND “AS AVAILABLE” and, to the extent permitted by applicable law, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, reasonable care and skill, or non-infringement. MEMENTO MORI and its suppliers do not offer warranties regarding the MEMENTO MORI Material, software, texts, downloads, graphics, and links, nor the results that can be obtained from  the use of the website.

To the extent legally permitted, MEMENTO MORI and its suppliers will not be liable for indirect, incidental, special, or consequential damages arising from the use of the information available on the website, nor for the loss of use, business interruption, loss of profits, or loss of data, regardless of the type of action for liability, whether contractual, tort (including negligence), or otherwise, even if MEMENTO MORI and/or its suppliers have been advised of the possibility of such damages.

Termination and suspension

MEMENTO MORI may terminate or suspend your access to and use of the website if MEMENTO MORI reasonably believes you have violated the provisions of these Terms of Use, if you have acted contrary to their letter and spirit, or if you have infringed the rights of MEMENTO MORI, its  subsidiaries, or third parties, without prior notice. You agree that MEMENTO MORI and/or its suppliers will not be liable to you or third parties for such modification or suspension. Unless otherwise indicated, the information and materials displayed on the website are included solely for the purpose of promoting MEMENTO MORI products and services and, in certain cases, to present products for sale through different means. MEMENTO MORI makes no representations that the MEMENTO MORI Material is appropriate or available for use in every country in the world. You will be responsible for complying with applicable local laws, considering that access to the MEMENTO MORI Material may not be legal for certain people or in certain countries. Our products are available in many parts of the world, but products shown on the website may not be available  in all regions. 

If any provision of these Terms of Use, or part thereof, is declared illegal, invalid, or unenforceable,  such provision or part will be understood as excluded from the Terms of Use, without affecting the legality, validity, and enforceability of the remaining provisions, unless otherwise provided by law.

These Terms of Use constitute the entire agreement between you and MEMENTO MORI regarding the use of the website and supersede and revoke any prior agreement, draft agreement, commitment, or ancillary contract of any kind entered into between the parties, whether verbal or  written, related to its subject matter. 

The waiver by MEMENTO MORI of any breach of any provision of these Terms of Use will not be  construed as a waiver of any subsequent breach.
